JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-04-2019 By way of the present restoration application, petitioner seeks to restore the Criminal Revision No.730 of 2016, which stood dismissed for non prosecution vide order dated 06.02.2019.
Submission of learned counsel for the petitioner is that due to not marking the list, the case has been dismissed and he is ready to pursue the case regularly, however, on query it appears that this case has been filed for restoration of Criminal Revision No.730 of 2016, which has been filed against the order allowing the maintenance and the learned counsel for the petitioner has admitted that he is not paying any amount of maintenance to opposite party no.2.

No.22778 of 2019(2) dt.17-04-2019 2/2 In such view of the matter, Criminal Revision No.730 of 2016 is restored to its original number with the condition that the petitioner will pay 50% of the amount of maintenance per month to the opposite party no.2 till any final decision made in the Criminal Revision No.730 of 2016.
Put up this case for admission on 16.05.2019 and on that day, petitioner will inform the Court whether he is paying the amount to opposite party no.2.
With the aforesaid direction, this application is allowed.
