JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 23-05-2017 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioners apprehend their arrest in connection with Kotwali P.S. Case No. 539 of 2016 for the offences punishable under sections 307 and 34 of the I.P.C and section 27 of the Arms Act.

Allegedly, the petitioners and other FIR named accused persons started opening fire with the revolver when the informant and others were protesting the encroachment made by them.

Submission is of false implication and that no offence

Patna High Court Cr.Misc. No.19032 of 2017 (2) dt.23-05-2017 2/2 under section 307 of the I.P.C. is made out, no injury has been caused to the informant, when the mob tried to attack the petitioners and their family members then the father of the petitioners opened fire in the air to protect themselves from the licensee government rifle, no offence, as alleged, is made out against the petitioners, co-accused Ashok Singh @ Ashok Kumar Singh and Manish Kumar Singh @ Manish Singh have already been allowed regular bail vide Cr. Misc. No. 55701 of 2016 and as such the petitioners also deserve sympathetic consideration. The learned A.P.P. submits that firing was made.

In the facts and circumstances as stated above, the petitioners, in case of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. C.J.M. Patna in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
