JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-04-2017 The petitioners are apprehending their arrest in connection with Chandramandih P.S. Case No. 41 of 2015, registered for offences punishable under Sections 323, 324, 325, 308 and 504/34 of the Indian Penal Code.

The allegation against these petitioners is of assaulting the sons of informant Pintu and Tuntun Poddar on the head respectively. It has been submitted on behalf of the petitioners that there is case and counter case and the persons from petitioners' side also received injuries and the injuries are superficial in nature.

Heard learned A.P.P. also.

Having heard both sides and from perusal of the record, it appears that both petitioners have assaulted the sons of

Patna High Court Cr.Misc. No.16662 of 2017 (2) dt.11-04-2017 2/2 informant causing injuries over the head and further it appears from the impugned order that the opinion with regard to the injuries kept reserved.

Considering the aforesaid facts, let the petitioners surrender and make prayer for regular bail which will be considered by the court below on the basis of facts that there is case and counter case between the parties and also nature of injury available on the persons of the injured and considering the same, the court below will pass appropriate order without being prejudiced by order of this court.
