JUSTICE SANJAY PRIYA ORAL ORDER 06-11-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Pirbahore P.S. Case No. 355 of 2018 instituted for the offence under Section 379 of the Indian Penal Code. Subsequently, Section 411 of the Indian Penal Code was added.

It is alleged in the written report that Purse of the informant containing key of Scooty, A.T.M. card, owner book of Scooty, Aadhar card and PAN were stolen away from Emergency Ward of PMCH, Patna.

Counsel for the petitioner submits that petitioner is not named in the written report. No TIP of the aforesaid article was done. The petitioner had gone to PMCH for treatment of his nephew. The police has arrested him in the instant case merely on

Patna High Court Cr.Misc. No.66276 of 2018 (2) dt.06-11-2018 2/2 suspicion. Counsel for the petitioner further submits that petitioner is in custody since 25.6.2018.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna, in connection with Pirbahore P.S. Case No. 355 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
