JUSTICE SANJAY PRIYA ORAL ORDER 25-10-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Kursa Kanta P.S. Case No. 141/2018, instituted for the offence under Section 414 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that there is no recovery of motorcycle from possession of this petitioner. Seizure-list is part of F.I.R., from which it appears that motorcycle has been recovered from the house of Mohan Mishra. It is alleged in the written report that police apprehended this petitioner and on the basis of disclosure made by him, motorcycle was recovered from the courtyard of Mohan Kumar Mishra.

Patna High Court Cr.Misc. No.63823 of 2018 (2) dt.25-10-2018 2/2 Learned counsel for the petitioner has submitted that petitioner has no concern with the aforesaid motorcycle. He has been falsely implicated in this case merely on suspicion. He is in custody since 25.06.2018.

Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Vth, Araria in connection with Kursa Kanta P.S. Case No. 141/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
