The petitioner, who is in custody, seeks bail in connection with Baniyapur P.S.Case No. 215 of 2010 registered under Sections 413 and 414 of the Indian penal Code. It is a case of misuse of bail by the petitioner and the case is at the stage of trial and he has been in custody since 07.09.2016.

Having considered the aforesaid facts and circumstances, let the petitioner, named above, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned VIII Additional Sessions Judge, Saran at Chapra in connection with Baniyapur P.S.Case No. 215 of 2010 with

Patna High Court Cr.Misc. No.50750 of 2016 (4) dt.08-02-2017 2/2 condition that petitioner shall be physically present before the court below on each and every date during trial and if he fails to appear on two consecutive dates, his bail bonds shall be liable to be cancelled.
