JUSTICE SATYAVRAT VERMA ORAL ORDER 29-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Sections 30(a), 30(b), 30(c) and 33 of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 26.02.2022, is a person with clean antecedent and charge-sheet has been submitted in the case. Allegation is of recovery of 420 litres of liquor and some articles from the house of co-accused Pankaj Paswan. Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and came to be implicated on suspicion as it is alleged that he was seen fleeing. Considering the fact that the petitioner is in custody since 26.02.2022, is a person with clean antecedent and chargesheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Madanpur P.S. Case No. 88 of 2022.
