The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 341, 323, 324, 325, 307 and 504 of the Indian Penal Code. It is alleged that the accused persons came variously armed and abused the informant when co-accused Anil Paswan resorted to two rounds of firing in the air. It is further alleged that when Bihari Manjhi, Sanjay Manjhi and Girendra Manjhi came to rescue they all were assaulted by the accused persons by means of iron rod and 'lathi' as a result Biran Manjhi and Girendra Manjhi
Patna High Court Cr.Misc. No.37661 of 2015 (2) dt.17-09-2015 2/2 sustained rupture injury on their head and Sanjay Manjhi sustained injury on his hand.
It is submitted by learned counsel for the petitioners that accusation of assault is omnibus and general and there is counter version of the occurrence wherein petitioners' side has also received injuries. Moreover, statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Munger in connection with Dharhara P.S. Case No.165 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
