JUSTICE SANJAY PRIYA ORAL ORDER 07-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Teghra P.S. Case No. 314/16 instituted for the offence under sections 414 of the Indian Penal Code and 11(i)(a,d,e,f,k) of P.C. Act and 47,48, 50,52,54, 56C of Transport of Cattle Rule.
It is alleged that informant on confidential information stopped a truck at Marsaiti Petrol Pump, National Highway-28 and found 22 bullock loaded on the truck. Most of the cattle were injured and driver of the truck Md. Iliyas and one Arun Kumar were also on the truck. The police arrested both persons and they did not produce any paper.
The police learnt during investigation that owner of the aforesaid truck is this petitioner.
Patna High Court Cr.Misc. No.9562 of 2017 (2) dt.07-03-2017 2/2 It is alleged that Arun Rai was purchaser of cattle and he has also produced the purchase paper which finds mentioned in the impugned order.
Be that as it may, from the written report, it appears that petitioner was not present on the spot. He is alleged to be owner of the aforesaid truck, carrying bullock It is mentioned in para-3 that the petitioner has no criminal antecedent.
Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner named above, within six weeks from today, in connection with Teghra P.S. Case No. 314/16, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai, subject to the conditions as laid down under Section 438(2) Cr.P.C.
