The petitioner seeks bail in connection with Daudnagar P.S. Case No. 646 of 2021 dated 15.12.2021 registered for the offence punishable under Section 366-A of the Indian Penal Code.

The allegation against the petitioner is that he kidnapped the minor daughter of the informant for marriage. Learned counsel for the petitioner submits that the allegation against the petitioner is false as the victim girl herself left her house.

Learned counsel for the petitioner further submits that in the statement recorded under Section 164 of the Cr.P.C. the victim girl herself stated that she had gone with the petitioner

Patna High Court CR. MISC. No.20305 of 2023(2) dt.18-05-2023 2/2 from Daudnagar to Gujarat and resided about one year with the petitioner. Further he has submitted that both the petitioner and the victim girl have solemnized marriage voluntarily and the petitioner is in jail custody since 07.12.2022 having no criminal antecedent.

Learned APP appearing for the State has opposes the prayer for bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner above named, be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Daudnagar P.S.
