The petitioner seeks bail in connection with Lalganj P.S. Case No. 350 of 2018 dated 02.10.2018 which initially was instituted for the offences under Sections 363 and 364 of the Indian Penal Code. The learned counsel for the State, Mr. Ram Priya Sharan Singh after going through the case diary has informed this Court that Section 302 IPC has been added on the confessional statement of the named accused persons viz. Mithun Sahani.

If further appears from the records that the brother of the informant was taken away to some unknown destination by aforesaid Mithun Sahani who never returned. Later, aforesaid Mithun Sahani appears

Patna High Court CR. MISC. No.26296 of 2019(4) dt.17-08-2019 2/2 to have been arrested in a case involving provisions of Arms Act. In the confession at the time of his arrest in the aforesaid case, he disclosed that he had given a contract to kill the deceased to one Arun Rai who after executing the work had come to accept money at the house of the petitioner, when the petitioner also was arrested.

The petitioner is in custody in this case since 01.11.2018.

Regard being had to the period of custody of the petitioner and nature of accusation, the petitioner is is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishalli in connection with Lalganj P.S.
