The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406, 420, 467/34 of the Indian Penal Code.
It is alleged that petitioner and two other persons namely Pawan Sing and Dhiran Tanti withdrew the money with regard to seven beneficiaries under the Indira Awas Scheme. It is further alleged that the petitioner was a Gramin Dak Sewak. The petitioner was not name in the FIR. Subsequently, the name of the petitioner sprang up during investigation only on suspicion. Moreover, all the accused persons have been granted regular bail by the learned court below.
I see no reason for the learned court below not to give
Patna High Court Cr.Misc. No.36336 of 2015 (2) dt.10-09-2015 2/2 the same privilege to the petitioner. Let the learned court below consider the prayer for regular bail of the petitioner, preferably on the same day, if the petitioner surrenders within a period of six weeks in connection with Muffasil P.S. Case No.41 of 2010, pending before the learned CJM, Begusarai.
With the above observation, this application is, accordingly, disposed off.
