JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-08-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 302/34 of the Indian Penal Code.

As per the prosecution case, on 25.07.2020 at about 5 PM this petitioner along with co-accused Pramila Devi and Laxman Ram are alleged to have committed the murder of informant's another son, Vinod Sahani, by assaulting him with firewood and throttling.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has committed no offence. There is general and omnibus allegation of assault against this petitioner and no specific overt act has been alleged against this

Patna High Court CR. MISC. No.30204 of 2021(2) dt.17-08-2021 2/2 petitioner. Petitioner is also son of the informant and has been made accused in this case due to some family dispute. Petitioner is in custody since 26.07.2020.

Learned counsel appearing for the State opposes the prayer for bail and submits that petitioner and two other accused persons committed the murder of son of informant. Considering the nature of allegation and gravity of offence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
