The application is for grant of bail in connection with Pachrukhi PS case no. 301 of 2015 for the offence under Sections 364(A)/34 and other sections of the Indian Penal Code. It is submitted on behalf of petitioner that name of the petitioner transpires in course of investigation in the confessional statement of co-accused and that co-accused has named several persons but they were granted bail by this Hon'ble Court. Apart from this, nothing recovered from possession of petitioner. It is further submitted that so far as criminal antecedent of petitioner is concerned, he is on bail on all six cases. Patna High Court Cr.Misc. No.49444 of 2016 (3) dt.17-01-2017 2/2 opposed the prayer for bail and submitted that he has criminal antecedent and he is accused in seven other cases. Having heard both sides. From perusal of petition, it appears that petitioner is accused in seven other criminal cases but considering the fact that there is nothing against the petitioner except confessional statement of co-accused and he is in custody for about 07 months and charge-sheet has already been submitted, the bail application of petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/-(Rs. Twenty five thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. VII, Siwan in connection with Pachrukhi PS case no.

301 of 2015 with a condition that both the bailors should be the local one having the property within the jurisdiction of learned court below with further condition that he will cooperate in the disposal of the case and petitioner shall make himself available on each and every date except on some genuine reason and failure to appear on two consecutive dates incur cancellation of bail bond of petitioner.
