The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 376, 420, 406 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
It is alleged that on promise of marriage coaccused Rakesh Manjhi established physical relationship with the informant. Thereafter the marriage was fixed, when this petitioner being the uncle of Rakesh Manjhi went to bride house to approve the girl, but subsequently the marriage was not performed.
It is submitted by the learned counsel for the petitioner that thrust of accusation is against Rakesh Manjhi and the petitioner has been roped in the present case only because
Patna High Court Cr.Misc. No.36700 of 2015 (2) dt.11-09-2015 happens to be uncle of Rakesh Manjhi. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Wazirganj P.S. Case No. 396 of 2013, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
