The petitioners apprehend their arrest in Ekma P.S. Case No. 389 of 2021, registered for the offences punishable under Sections 366/34 of the Indian Penal Code. As per the prosecution case, co-accused Munna Ram along with his friend kidnapped the wife of informant. It is further alleged that when the informant went to complain at the house of petitioner, these petitioners abused and threatened the informant.

It is submitted that specific allegation of kidnapping is

Patna High Court CR. MISC. No.20563 of 2022(2) dt.01-09-2022 2/2 against co-accused Munna Ram and his friend. Petitioners are separate in mess and property from the co-accused Munna Ram. Petitioner nos. 1 and 2 are husband and wife and petitioner no. 3 is married daughter of petitioner nos. 1 and 2. Petitioners are only alleged to have threatened the informant. Petitioners claim clean antecedent.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran in connection with Ekma P.S. Case No. 389 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
