JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 22-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

During course of vehicle checking, two Scorpio bearing Registration No.BR-09H-8522 as well as BR-09R-8110 were intercepted and on search, from the Scorpio bearing Registration No.BR-09R-8110, altogether 144 litres foreign wine of Indian origin were seized. Furthermore, petitioner being driver of the aforesaid vehicle as well as another occupant, Manish Kumar were apprehended. Petitioner has got no criminal antecedent as is evident from Para-3 of the petition. Petitioner happens to be under custody since 25.07.2016. Considering status of the petitioner in consonance with the period of detention, petitioner, Rahul Kumar is directed

No.52582 of 2016 (02) dt.22-12-2016 to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Chakai P. S. Case no.81 of 2016, with a direction to the learned lower court to verify the genuineness of the bailors before acceptance of the bail bond in order to secure presence of petitioner during trial.
