2. The petitioner apprehends arrest in connection with Bhabua PS Case No.937 of 2024 dated 25.11.2024, instituted under Sections 126(2), 115(2), 109, 118(1), 302(2), 351(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. The allegation against the petitioner is that he assaulted the informant on his head by means of knife.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Further submission is that allegation against the petitioner is that he assaulted the informant with knife on his head and his brother also assaulted the informant by means of knife. It is also submitted that the FIR has been lodged against two named and two unknown accused. The injury report of the informant shows

No.18982 of 2025(2) dt.16-04-2025 2/2 that he received two sharp cut injury; one on the head and another on the left hand of the informant and both the injuries were simple in nature. Further submission is that on account of PACS election the petitioner and his brother have been implicated in this case because they were the supporters of rival party. Further submission is that both the parties are the resident of the same village. Lastly, it is submitted that one criminal case is pending against the petitioner.

5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua, in Bhabua PS Case No.937 of 2024, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

7. The application stands allowed.
