2. This is the second attempt of the petitioner for grant of regular bail in connection with Bathnaha P.S. Case No. 19 of 2024 registered for the offence under Sections 8, 20(b)(ii) (b) of the NDPS Act.

3. The recovery is of 5 kg of Ganja.

4. The petitioner is in custody since .1.04.2024 and he claims to have clean antecedent.

5. Considering the facts of the case and also considering the period of custody, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of

Patna High Court CR. MISC. No.18990 of 2025(2) dt.02-05-2025 2/2 the learned Principal District and Sessions Judge-cum-Special Judge, Araria/concerned Court below in connection with Bathnaha P.S. Case No. 19 of 2024.

7. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Jogbani Police Station on every Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.

8. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.

9. As the petitioner claims to have clean antecedent, the Court below, before accepting the bail bonds of the petitioner is directed to verify the antecedent of the petitioner. If the petitioner is found to be involved in any other case then the bail bonds of the petitioner shall not be accepted. (Sandeep Kumar, J) Vikas/- U
