JUSTICE SANDEEP KUMAR ORAL ORDER 15-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Nokha P.S. Case No. 324/2022, registered for the offence punishable under Sections 30(a), (c), (d) of the Bihar Prohibition and Excise Amendment Act, 2018.

Learned counsel for the petitioner submits that the petitioner is innocent and falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 11.02.2023.

Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation levelled against

Patna High Court CR. MISC. No.23432 of 2023(2) dt.15-05-2023 2/2 the petitioner, his period of custody, this application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Exclusive Special Excise Court No. 2-cum-Addl. District & Sessions Judge, Rohtas at Sasaram connection with Nokha P.S. Case No. 324/2022.
