2. The present writ petition has been preferred for the following relief(s):

for issuance of appropriate writs and directions to the respondents for removing forthwith the earthwork being done over the Lands. Road forcibly in the petitioner's land and be pleased to direct the Respondents fill the ditch made by Respondents Land of the petitioner digging earth for earthwork of the road in question from the Lands of the

Patna High Court CWJC No.11899 of 2015(3) dt.14-07-2025 2/2 petitioner and be further pleased to restrain the Respondents from construction of the Road in the land of the petitioner during the pendency of the writ application and be further pleased to grant heavy compensation as well as other relief(s) for which the petitioner is found entitle to.

3. Paragraph 3 of the counter affidavit on behalf respondent no. 9 shows that the construction has been made by the District Board, Vaishali with his consent.

4. Learned State Counsel submits that in that background, it is the District Board, Vaishali, Hajipur which has to decide the matter.

5. Learned counsel for the petitioner submits that he shall be approaching the concerned respondent in four weeks.

6. If the petitioner approaches the Executive Officer, District Board, Hajipur in next four weeks, he shall be taking up the matter after hearing the parties, shall take the matter to its logical conclusion in next four months.

7. The writ petition stands disposed of.
