The petitioner is apprehending his arrest in connection with Complaint Case No.330 of 2014, Tr. No.1459 of 2016 registered for offences punishable under Section 498A of the Indian Penal Code.

It is submitted on behalf of the petitioner that the marriage was solemnized 18 years ago and he has one son aged about 10 years and he is still ready to keep his wife with all dignity and care and he undertakes to the said effect.

Heard learned A.P.P. also.

Having heard both sides and in view of above submissions,

Patna High Court Cr.Misc. No.14808 of 2017 (2) dt.03-04-2017 2/2 let the petitioner surrender before the court below, who will release the petitioner on provisional bail of Rs.25,000/- of the like amount and in the meantime, he will call upon both the parties on a date fixed and in view of undertakings of the petitioner, he will enquire from the Opposite Party No.2 as to whether she is ready to live with him or not. After examining the conduct of both the parties, either he will confirm the bail bond of the petitioner or he will pass any other appropriate order.

With the aforesaid observation, this application is disposed of.
