JUSTICE SATYAVRAT VERMA ORAL ORDER 23-11-2021 Heard the learned Advocate for the petitioner, learned counsel for the informant and the learned APP for the State. The petitioner seeks bail in connection with Daudnagar P. S. Case No.481 of 2020, instituted for the offences under Sections 341, 323, 307, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner is in custody since 25.12.2020 and he claims to be a person of clean antecedents. Charge-sheet has been submitted in this case.

From bare perusal of the allegation as alleged in the F.I.R., it would manifest that the informant alleges that this petitioner was having an altercation with the informant when Roushan Kumar fired at the informant which hit him near his neck causing injury.

Patna High Court CR. MISC. No.29428 of 2021(2) dt.23-11-2021 2/2 Learned counsel for the petitioner submits that the allegation against this petitioner is that he was having an altercation with the informant whereas the allegation of firing is on co-accused Roushan Kumar.

The learned counsel for the informant as well as learned A.P.P. for the State opposed the bail prayer and submits that during course of investigation, it has come that the named accused persons have committed the occurrence, but on query that the allegation of firing is upon Roushan Kumar, the learned counsel fairly submits in the affirmative.

Considering the facts afore-stated, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Daudnagar, Aurangabad in connection with Daudnagar P. S. Case No.481 of 2020.

The application stands allowed.
