The petitioner being the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 304B/201/120B of the Indian Penal Code.

Accusation is of killing the daughter of the informant after two years of marriage for non-fulfillment of dowry demand.

It is submitted by learned counsel for the petitioner that there is no complaint with regard to demand of dowry and torture. Moreover, the informant has retracted from the initial version and has filed a petition to that effect before the learned court below,

Patna High Court Cr.Misc. No.36339 of 2015 (2) dt.09-09-2015 2/2 the same has been brought on record as annexure-2 to the petition.

The aforesaid facts constitute ground for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner keeping in view retracted version of the informant, if the petitioner surrenders within a period of six weeks in connection with Turkauliya P.S. Case No.264 of 2015, pending before the learned Chief Judicial Magistrate, Motihari, East Champaran. With the above observation, this application is, accordingly, disposed off.
