Petitioner is languishing in custody in connection with Daraunda P.S. Case No. 149 of 2016 for offences punishable under Section 414 of the Indian Penal Code.

From the house of co-accused Sonu Manjhi three motorcycles were recovered, which were allegedly stolen property. The petitioner was also in the house of Sonu Manjhi. Nothing was recovered on search from the person of the petitioner. However, petitioner disclosed to the police that one of the motorcycles belongs to the petitioner; hence, petitioner was suspected to be in possession of stolen property. Submission is that false allegation is there and the petitioner is in custody since 29.09.2016.
