JUSTICE SANJAY PRIYA ORAL ORDER 23-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Kawakole P.S. Case No. 04 of 2017 instituted for the offence under sections 30(a) of Bihar Prohibition and Excise Act.

It has been submitted that petitioner has clean antecedent. He is neither owner of the vehicle nor apprehended on the spot. The vehicle does not belong to this petitioner. He has been named merely on suspicion.

As per written report, police got information that petitioner along with three unknown persons has parked the vehicle loaded with country-made liquor and thereafter, the police reached in front of the house of Ram Chandra Sao where they found the car which was searched and country made spiced liquor was recovered as mentioned in the seizure list.

It is mentioned in para-3 of the petition that the petitioner has no criminal antecedent.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner named above, within six weeks from today, in connection with Kawakole P.S. Case No. 04 of 2017, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Nawada, subject to the conditions as laid down under Section 438(2) Cr.P.C.
