JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-06-2019 This is an application for grant of anticipatory bail in connection with Paraiya P.S. Case No. 115 of 2018, disclosing offences under Sections 342, 323, 307, 325, 379 of the Indian Penal Code.
Allegation against the petitioner and other accused persons is that they surrounded the informant and petitioner assaulted by Pasuli, causing injury on his head. Apart from that petitioner is an accused in some other cases. Submission of the learned counsel for the petitioner is that the present case has been lodged against the petitioner at the instance of Janak Prasad and due to land dispute, other cases has also been lodged at the instant of Janak Prasad and a case has been lodged by the petitioner's side also against the informant and others.
Heard learned A.P.P. as well as learned counsel
Patna High Court CR. MISC. No.20931 of 2019(5) dt.19-06-2019 2/2 appearing on behalf of the informant also, who has opposed the prayer for bail on the ground that the injury was found dangerous to life.
Having heard both sides, in view of the aforesaid facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner may surrender before the learned court below and make prayer for regular bail, which will be considered on its own merit.
