2. The petitioners are in custody since 05.07.2016 in connection with Nasriganj P.S. Case No. 121 of 2016 for the offences alleged under Sections 272, 273, 120B of the Indian Penal Code and Sections 47(A), 51, 57, 63 of Bihar Excise (Amendment) Act, 2016.
3. It is submitted that the petitioners have been falsely implicated and the only accusation is that they were fleeing from the spot. No recovery of incriminating articles has been made from the possession of the petitioners. The owner of the poultry farm in question, namely co-accused Pintu Kumar has been granted anticipatory bail by this Court in Cr. Misc. No. 36655 of 2016. Other co-accused Ravi Shankar Sharma and Rohit Kumar @ Jackie have also been granted bail and anticipatory bail respectively by this Court in Cr. Misc. No. 39185 of 2016 and Cr. Misc. No. 37811 of
4. Having regard to the entirety of the facts and circumstances of the case, let the petitioners above named be
Patna High Court Cr.Misc. No.41531 of 2016 (2) dt.04-10-2016 2/2 released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bikramganj, District- Rohtas in connection with Nasriganj P.S. Case No. 121 of 2016 with the following conditions: (i) That one of the bailors of each of the petitioners shall be their close relative other than the petitioners herein. (ii) That the petitioners shall not indulge in any similar offence till conclusion of the trial.
(iii) That the petitioners shall remain physically present in Court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reason, their bail bonds shall be liable to be cancelled by the learned Court concerned.
