JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-09-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 448, 387, 323, 379 and 504/34 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged that the accused persons including the petitioners assaulted the informant for not making payment of extortion demand and also snatched `3,500/-.

It is submitted by learned counsel for the petitioners that for the petty dispute, the accusation has been levelled and the petitioners' side lodged Bhabua P.S. Case No. 276 of 2015 against the informant on 24.05.2015 at 3 PM when the present case was

Patna High Court Cr.Misc. No.36172 of 2015 (2) dt.14-09-2015 2/2 lodged on the same day at 3.15 PM. The injury received by the informant is simple in nature. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kaimur at Bhabua in connection with Bhabua P.S. Case No. 277 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
