The petitioner apprehends his arrest in Kadamkuan P.S. Case No.499 of 2018 registered under Sections 341, 323, 353 of the Indian Penal Code and under Section 3 of the Defacement of Public Property Act.
The informant alleged that the petitioner being the owner of Laddu Gopal Sweets encroached upon the road by constructing stairs but when the encroachment removal team went there, the petitioner entered into scuffle and put hindrance in discharge of official duty.
Learned counsel for the petitioner submits that no illegal construction was made by the petitioner and so the petitioner only insisted for measurement of the land but the authority lodged the case against the petitioner making false

Having considered the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate VII, Patna in connection with Kadamkuan P.S. Case No.499 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
