The petitioner seeks bail in connection with Raniganj P.S. Case No. 54 of 2016 registered for the offence punishable under Section 304(B)/34 of the Indian Penal Code. Bibi Saddam Khatoon, daughter of the informant was married to the petitioner about three years ago and she was being assaulted by the petitioner and ultimately the petitioner and others killed her for not fulfilling the demand of dowry. Submission is of false implication and that there is omnibus and general allegation, the petitioner is suffering in custody since 08.03.2016 and, as such, the petitioner deserves sympathetic consideration.
Patna High Court Cr.Misc. No.3296 of 2017 (3) dt.03-04-2017 The learned A.P.P. seriously opposes the prayer of bail by submitting that it was the petitioner who was demanding dowry and he used to assault her and further the doctor has found the cause of death is asphyxia as a result of strangulation. In the facts and circumstances stated above, considering the allegation attributed against the petitioner, at present I am not inclined to enlarge the petitioner on bail and accordingly, his such prayer stands rejected in connection with Raniganj P.S. Case No. 54 of 2016 pending in the Court of learned Sub-Divisional Judicial Magistrate, Araria.
