The petitioner apprehends his arrest in Shastrinagar P.S. Case No.20 of 2019 registered under Sections 420, 467, 468 and 471 of the Indian Penal Code.
The gist of the allegation against the petitioner is that the petitioner in pursuance of a tender notice submitted quotations along with the requisite papers but on scrutiny, it transpired that the petitioner submitted forged experience certificate in order to get the tender.
The learned counsel for the petitioner submits that the experience certificate was submitted by staff of the petitioner. The authority has already taken alternative recourse to forfeit the earnest money/security deposited by the petitioner and to
Patna High Court CR. MISC. No.21384 of 2019(2) dt.05-04-2019 2/2 blacklist the petitioner from participating in future tender. It is further submitted that no financial loss is caused to the Bihar State Building Construction Corporation Ltd.. Taking into consideration the fact that authority has already taken alternative recourse for forfeiting earnest money/security and blacklisting the petitioner for preventing him to participate in future tender, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge IVcum-A.C.J.M., Patna in connection with Shastrinagar P.S.
