Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419, 420, 467, 468, 471, of the Indian Penal Code and Rule 40(1) of the Bihar Minor, Mineral Concession Rules, 1972 Act. A truck loaded with stone chips was intercepted when the driver produced the challan which was found to be forged. On verification, it was found on the report of Mining Officer, Giridih that never such permit was issued in favour of M/S Maa Durga Stone Works.

It is submitted by learned counsel for the petitioner that petitioner is owner of the truck, admittedly the petitioner was not on the truck when it was intercepted. The stones were being carried on a public carrier and the driver was

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram(Agrer) P.S. Case No. 659 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
