JUSTICE SUDHIR SINGH ORAL ORDER 03-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Section 414 of the I.P.C.

The prosecution story, in brief, is that on the alleged date and time of occurrence while the informant along with police personnel was on patrolling duty and reached near Khanka Tinbatiya, he saw two persons riding on motorcycle. On seeing the police party they started to flee away. On chase one person was apprehended, who disclosed his name as Md. Saddam and other accused Sonu succeeded in fleeing away. On search some parts of motorcycle was recovered from the jut bag and a seizure list was prepared.

It has been submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.34607 of 2016 (3) dt.03-10-2016 the petitioner is in custody since 16.6.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedents. There is no allegation of tampering of witnesses alleged against the petitioner. The name of the petitioner has come on the basis of disclosure made by the co-accused, namely, Md. Saddam, who was apprehended with a motorcycle. The said accused has been granted bail vide Annexure-2 to the present application.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Kasim Bazar P.S. case No.81 of 2016.
