Petitioner is an accused in connection with Maharajganj P.S. Case No. 311 of 20190 for the offence registered under Sections 302, 120B/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, there is general and omnibus allegation against the petitioner and the specific allegation of firing at the deceased is attributed to the co-accused. No arms have been recovered from the possession of the petitioner. The petitioner is rotting in judicial custody since 03.12.2019.
