2. Since both the bail applications have been preferred by the petitioners for grant of their regular bail, who have been arrested in connection with Jhajha P.S. Case No. 499 of 2024 registered for the offence punishable under Sections 103(1), 238

Patna High Court CR. MISC. No.23108 of 2025(3) dt.16-05-2025 2/3 and 3(5) of the Bharatiya Nyaya Sanhita, both the petitions are being decided by this common order.

3. According to the case of prosecution, on 01.11.2024 at about 08:00 P.M. co-accused Arti Devi, called the deceased Tuntun Kumar Singh. On being called by her, he left his house, thereafter, he did not return. Subsequently, on 03.11.2024, dead body of Tuntun Kumar was found lying at village Gudiara Bahiyar. The matter was reported by the mother of the deceased Usha Devi, on the basis of which offence has been registered against the accused persons.

4. It is submitted by the learned counsel for the petitioner that petitioners is innocent and have falsely been implicated in the present case. The name of the petitioners have been mentioned in the present case only on suspicion. Apart from the confessional statement, there is no any other evidence available on record on the basis of which it can be said that the petitioners herein are also involved in the crime in question. Lastly, he submits that both the petitioners are in custody since 04.11.2024 and co-accused namely, Sanjay Choudhary and Shrawan Choudhary have already been allowed regular bail by this Court vide its order dated 13.05.2025 passed in Cr. Misc. Nos. 15519 of 2025 and 23689 of 2025 respectively. Therefore,

5. Learned counsel for the State opposes the arguments raised by the counsel for the petitioners.

7. Perused the case diary and other materials available on record.

8. Considering the submissions made by the counsel for the petitioners and further taking into consideration the materials collected by the prosecution, I am of the view that it is a case where the petitioners should be granted benefit of bail.

9. Accordingly, the application is allowed.

10. The petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., Jamui in connection with Jhajha P.S. Case No. 499 of 2024.
