Learned Additional Public Prosecutor for the State is present during course of the day and pointed out that earlier vide order dated 5th August, 2014 passed in Cr. Misc. No. 13375 of 2014, in connection with Baheri P.S. Case No. 387 of 2013 pending before Chief Judicial Magistrate, Darbhanga, after some arguments when prayer of the petitioners (petitioner nos. 2 and 3 there) was going to be turned down, but on their prayer made at the relevant time, the application stood disposed of as withdrawn and the remaining two petitioners there were granted privilege of bail by same order.

Considering the facts and circumstances, there appears no reason to entertain this application, accordingly, the same stands disposed of. Both the petitioners are directed to surrender before the court below immediately, failing which, the court below is directed to do all the needful in accordance with law securing their attendance at the earliest.
