The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 302, 504, 506/34 of the Indian Penal Code.
It is a case of commission of murder of the brother of the informant namely Rupesh Thakur. It is submitted by learned counsel for the petitioner that in the background of some land dispute,
Patna High Court CR. MISC. No.22893 of 2022(2) dt.29-09-2022 2/3 the present F.I.R has been registered. There is general and omnibus allegation against the petitioner. The specific accusation of making assault to the deceased is against Subhash Thakur. It is further submitted that after completing investigation, final form has been submitted against the petitioner and petitioner was not sent up for trial, but differing with the final form, cognizance has been taken against the petitioner. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
Considering the fact that petitioner is a lady and no specific accusation of assault has been attributed against her, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st, Class, Naugachia, Bhagalpur in connection with
