The petitioner apprehends his arrest in Sahar P.S. Case No. 81 of 2016 instituted for the offence under Section (s) 409 of the Indian Penal Code.

It is alleged against this petitioner that petitioner being Panchayat Secretary did not provide the folder with regard to appointment of contract teachers in compliance of the order of this Court passed in C.W.J.C. No. 15439 of 2015 as demanded by the Vigilance for the period 2006-08. It has been submitted on behalf of the petitioner that petitioner was posted in the aforesaid block on 02.08.2010 and he was transferred from that block on 24.08.2012. The instant

In this manner, the petitioner has submitted that he was not in possession of any of the documents related to the appointment of the contract teachers for the period as mentioned in the written report.

In the facts and circumstances of the case, the prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, above named, within six weeks from today in connection with Sahar P.S. Case No. 81 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 10th Ara, Bhojpur, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
