The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 307, 337, 338, 504, 506/34 of the Indian Penal Code.
It is alleged that co-accused Dhiraj Mandal assaulted with iron rod on the head of the informant. Subsequently, petitioner no. 1 Rupesh Kumar Mandal and petitioner no. 3 Rakesh Mandal also assaulted the informant. Co-accused Narsing Mandal caused injury to the brother of the informant by throwing bricks then the accused persons also assaulted the other persons.
Patna High Court Cr.Misc. No.31247 of 2015 (2) dt.31-07-2015 It is submitted by the learned counsel for the petitioners that the injuries of the informant and his brother has been found to be lacerated and swelling. There is counter version of the occurrence and father of the petitioners died due to injuries caused by the informant's side. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Munger in connection with Kasim Bazar P.S. Case No. 64 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
