====================================================== CORAM: HONOURABLE MR. JUSTICE KHATIM REZA ORAL ORDER 23-04-2025 Heard learned counsel for the petitioner; learned A.P.P. for the State and learned counsel for the opposite party no. 2.

2. The petitioner seeks bail in connection with Muffasil P.S. Case No. 58 of 2025 dated 16.02.2025, instituted for the offence punishable under Sections 137(2), 87 and 3(5) of the B.N.S. in which on the application of I.O. Sections 4/6 of the POCSO Act has been added.

3. The allegation against the petitioner is that he

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that statement of the daughter of informant was recorded under Section 181 of the B.N.S.S. in which she deposed that she went with the petitioner on her own sweet will and married him. It is next stated that as per the matriculation certificate, O.P. no. 2 was 17 years 11 months 10 days at the time of occurrence. It is also submitted that after recording of the statement under Section 183 of the B.N.S.S., the O.P. No. 2 was sent to his matrimonial house with her inlaws. Lastly, it has been submitted that the petitioner is in custody since 17.02.2025 having no criminal antecedents and charge-sheet has been submitted in the case.

5. Learned counsel for O.P. No. 2 submitted that O.P. No. 2 (daughter of the informant) is living peacefully with her in-laws in matrimonial house.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount
