The petitioners apprehend their arrest in Ara Muffasil P.S. Case No. 62/2015, registered for the offences punishable under Sections 341, 323, 307, 385, 504/34, 506 of the Indian Penal Code.

The informant alleged that Pramod Yadav demanded extortion and Lallu Yadav asked to kill the informant. On such, Binod Yadav @ Binod Kumar Yadav (petitioner no. 1) caught the informant and Pramod Yadav assaulted the informant with knife. It is submitted that the petitioner Binod Yadav also filed a complaint case under Sections 394, 323, 341 and 504 of the Indian Penal Code for the occurrence of the same day but the said complaint was not registered. There is no allegation of assault against the petitioners but it appears that Petitioner no. 2 asked to

Patna High Court Cr.Misc. No.36889 of 2015 (3) dt.04-11-2015 2/2 kill due to non-fulfillment of extortion and on such petitioner no. 1 caught the informant. Pramod Yadav assaulted the informant with knife. As many as four injuries are found on different parts of the body of the informant and the injuries are caused by sharp edged weapon.

Considering the facts aforesaid, I am not inclined to enlarge the petitioners above named on anticipatory bail. Accordingly, the same is rejected.
