JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-10-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks regular bail in connection with Giriyak P.S.Case No. 182 of 2018, registered for offences punishable under Sections 341, 323, 385, 504 of the Indian Penal Code and under Section 27 of Arms Act.

As per F.I.R. allegation against the petitioner is of recovery with a country made pistol and 11 cartridges of 315 bore from the courtyard of the petitioner with nine empty cartridges and accordingly, seizure list has been prepared.

Submission of the learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and the

Patna High Court Cr.Misc. No.60489 of 2018 (2) dt.06-10-2018 2/2 petitioner is in custody since 11.05.2018 and charge sheet has already been submitted against the petitioner also. Heard learned A.P.P. opposes the prayer for bail. Having heard both sides and in view of the facts and circumstances, I am not inclined to grant privilege of bail to the petitioner at this stage, and accordingly this application has been rejected. However, the learned Trial court shall release the petitioner after framing of charge on its own satisfaction. With the aforesaid observation, the instant petition is disposed of.
