JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-06-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under section 370, 370(A), 371, 372, 373, 376(c), 34 of Indian Penal Code and Sections 75 and 79 of the J.J. Act, and Sections 4, 6 of the POCSO Act. It is alleged that the petitioner is the owner of the Orchestra in which minor girls were sexually exploited and abused.

It is submitted on behalf of the petitioner that the petitioner is simply a victim of false implication due to police mechanism. He further submitted the apprehended girls have not alleged anything against the petitioner.

Learned counsel for the State opposed the prayer for

Patna High Court CR. MISC. No.20402 of 2023(2) dt.26-06-2023 2/2 pre-arrest bail and submitted that petitioner was indulged in buying and selling of minor girls for the purpose of running Orchestra. Petitioner has got two criminal antecedents of similar nature.

Considering the fact that petitioner has got two criminal antecedents of similar nature, prayer for pre-arrest bail of the petitioner is rejected.
