Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defect(s) as pointed out by the office when called upon to do so by the office. The petitioner is apprehending his arrest in a case registered for the offences punishable Sections 341, 323, 376, 504 and 379/34 of the Indian Penal Code.
It is a case of committing the sexual relation with the victim by co-accused Vishendra Sharma.
It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the petitioner is not named in the FIR and
Patna High Court CR. MISC. No.30264 of 2021(2) dt.14-02-2022 2/2 there is no specific allegation against this petitioner and during course of investigation, the petitioner's name has transpired. Learned APP appearing for the State has opposed the prayer for anticipatory bail.
In the facts and circumstances of the case, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Patna in connection with Patahi P.S. Case No. 78 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) brajesh kumar/- U T
