JUSTICE ARUN KUMAR JHA ORAL ORDER 10-12-2024 Learned counsel for the petitioners seeks permission to convert the present petition into Misc. Appeal which is opposed by learned counsel appearing on behalf of the respondents.
2. Learned counsel for the respondents submits that the petitioners should have mentioned at the outset that the
Patna High Court C.Misc. No.389 of 2023(8) dt.10-12-2024 2/2 present petition was not maintainable since the impugned order is an appeable one. Still, a number of adjournments have been sought and granted and the matter has been kept pending for almost one year.
3. Having regard to the submissions made on behalf of the parties, learned counsel for the petitioners is permitted to convert the present petition into Misc. Appeal within two weeks from today.
4. Office is directed to extend all cooperation towards conversion.
