JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 22-04-2024 Heard learned counsel for the petitioners and learned counsel for the informant as well as learned Additional Public Prosecutor for the State.
2. The petitioners are apprehending their arrest in a case in connection with Civil Lines P.S. Case No. 707 of 2023 dated 13.11.2023 registered for the offence/s punishable u/ss 341, 323, 324, 325, 307, 379, 504 and 506 read with section 34 of the Indian Penal Code.
3. As per the prosecution case, the petitioners are alleged to have entered the shop of the informant and demanded sweets as they claimed themselves as Rangdar of Gaya City.

On being protested, the petitioner no. 1, Virat Kumar assaulted the informant on his nose with iron punch causing injury. When his staffs came to rescue, they also assaulted his one of the staffs, Krishan Chowdhari with legs and abused them and thereafter they fled away.
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. There is case and counter case between the parties. It is further submitted that the dispute between the parties has been compromised out side the court. The injury is stated to be grievous in nature. There is no repetition of blow. The petitioner no. 1 had no intention to cause death of the informant. The petitioners have no criminal antecedent as stated at para 3 of the bail petition.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners. However, learned counsel for the informant has fairly submitted that the dispute between the parties has been compromised out side of the court.
6. Considering the aforesaid facts and circumstances of the case, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be

No.23464 of 2024(2) dt.22-04-2024 3/3 enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty thousand) each with two sureties of the like amount each to the satisfaction of learned court concerned, Gaya in connection with Civil Lines P.S. Case No. 707 of 2023, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
7. This application stands allowed.
