JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 22-01-2015 The petitioner no. 1 has been arrested and as such by order dated 13.10.2004, the application against the petitioner no. 1 has been withdrawn. Now this order relates to petitioner no. 2 only.

Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner, apprehending her arrest in connection with Pirpainty P.S. Case No. 26 of 2014 registered for the offences punishable under Section 366 (A) and 120B/34 of the Indian Penal Code, seeks the privilege of pre-arrest bail. It is submitted that the allegation of kidnapping is against Sonu Ravidas and the petitioner being the mother of Sonu

Patna High Court Cr.Misc. No.30489 of 2014 (3) dt.22-01-2015 Ravidas is apprehending her arrest also. The victim girl has given her statement under Section 164 Cr.P.C. wherein she has not alleged anything against the petitioner.

In view of the statement recorded under Section 164 Cr.P.C., the petitioner, in case of her arrest or surrender within two months from the date of receipt/production of the copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate., Bhagalpur in connection with Pirpainty P.S. Case No. 26 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
