====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-10-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Haveli Kharagpur P.S. Case No.183 of 2018 registered under Sections 406 and 354(c) of the Indian Penal Code besides Sections 66(E) and 67(A) of the I.T. Act.

The accusation is that the informant Rachna Singh used to do the work of clerk in Q-Max Public School, where the petitioner was also a teacher. Thereafter, they fallen in good relation. On 31.12.2017, On giving allurement to perform the marriage with her, the petitioner took her on a motorcycle to Jilebia More and without her consent forcibly started to misbehave with her and made video clip and uploaded the same on You-tube. Thereafter, the petitioner from his mobile talked several times with the informant and put

Patna High Court Cr.Misc. No.62530 of 2018(2) dt.08-10-2018 2/2 pressure upon her to perform marriage and also gave threatening to the informant, not to leave her alive in the society, if she will not perform the marriage.

Learned counsel appearing on behalf of the petitioner submits that, in fact, there was love affair in between the informant and the petitioner. While the petitioner wanted to perform the marriage with the informant but the family members of the informant were not ready and due to that reason, they got managed the informant to lodge this false case. The petitioner having no criminal antecedent is in custody since 20.07.2018.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IV, Munger, in connection with Haveli Kharagpur P.S. Case No.183 of 2018.
