In this case, the petitioner is seeking regular bail in connection with Sherghati (Dobhi) P.S. Case No. 54 of 2019 (N.D.P.S. Case No. 11 of 2019) registered for the offence under Sections 414/34 of the Indian Penal Code, under Sections 30(a) (d) of the Bihar Prohibition and Excise Act, 2016 and under Sections 18, 19, 20 and 21 of the N.D.P.S. Act. In paragraph no.3 of the bail petition, it has been stated that the petitioner is accused in two other criminal cases but, the case diary shows that the petitioner is also accused in different criminal cases. Hence, it is a suppression of material fact regarding criminal antecedents.

In such view of the matter, this bail petition is dismissed alone on the ground of suppression of material fact

Patna High Court CR. MISC. No.19205 of 2020(5) dt.09-03-2021 2/2 with cost of Rs.5,000/- to be deposited by the person, who has sworn the affidavit in this bail petition, in the coffers of the Patna High Court Legal Services Committee within a period of four weeks from today, failing which, the aforesaid amount of cost will be recovered from the person concerned by the Collector, Gaya, as land revenue.
